Terms of Service

The rules that govern the use of the Kirya platform. Please read them carefully before using our services.

1. Acceptance of Terms

By accessing and using the Kirya platform ("Service"), operated by Kirya ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you should not use the Service. These Terms apply to all users, including guests, hosts, property developers, and visitors.

2. Description of Service

Kirya is a property platform that connects property owners ("Hosts") directly with guests and buyers. We facilitate the listing, discovery, and booking of properties. For our rental marketplace, Kirya charges hosts a flat monthly subscription fee with zero commission on bookings. For our Developer Services product, Kirya charges a monthly subscription plus a commission on completed sales. Full pricing details are available on our Subscriptions page.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By creating an account, you confirm that you meet these requirements. If you are using the Service on behalf of a company, you confirm that you have the authority to bind that company to these Terms.

4. User Accounts

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and keep your account details up to date. You must notify us immediately if you suspect any unauthorised use of your account.

5. Host Responsibilities

Hosts are responsible for ensuring the accuracy of their property listings, including descriptions, photos, pricing, and availability. Hosts must comply with all applicable local laws and regulations, including rental licensing, tax obligations, building safety standards, and insurance requirements. Hosts must have the legal right to rent or sell the properties they list. Hosts agree to respond to guest inquiries promptly and to provide a safe, clean, and accurately represented property.

6. Guest Responsibilities

Guests agree to treat listed properties with respect, follow any house rules set by the host, communicate honestly, and pay for any damages caused during their stay. Guests must provide accurate personal information and must be of legal age to enter into rental agreements in their jurisdiction. Guests are responsible for reviewing the property details, cancellation policy, and house rules before completing a booking.

7. Bookings and Payments

Bookings are confirmed once payment is processed. Payments are handled securely through Stripe, our payment processing partner. Hosts receive payouts directly to their connected bank account. Kirya does not hold or manage guest funds beyond the payment processing stage. Guests pay the host directly for the booking, and hosts keep 100% of the booking amount. Kirya earns revenue solely through host subscription fees.

8. Subscriptions

Host subscriptions are billed monthly or annually, depending on the plan selected. Subscriptions auto-renew unless cancelled before the end of the current billing period. You can cancel your subscription at any time from your dashboard. There are no cancellation fees and no lock-in contracts. For full cancellation details, please see our Cancellation Policy.

9. Developer Services

Our Developer Services product is governed by a separate Developer Services Agreement signed between Kirya and the property developer. This agreement covers commission rates, lead attribution windows, digital reservation agreements, and the full terms of engagement. Developers should refer to their individual agreement for specific terms.

10. Host Cancellation Penalties

Kirya enforces strict penalties when a host cancels a confirmed booking. Penalties include a financial fee proportional to the booking value (10% to 100% depending on timing, minimum 50 euros, maximum 2,000 euros), calendar blocking of the cancelled dates, search ranking demotion, Host Score reduction, badge removal, and progressive suspension for repeat offenders. 11. Guest Cancellation Policies

Cancellation policies are set by individual hosts and clearly displayed on each listing before booking. Guests should review the cancellation policy before completing a booking. Kirya charges zero service fees to guests, so refunds are calculated on the full booking amount with no hidden deductions. Our full cancellation options are outlined on our Cancellation Policy page.

12. Fees and Debt Recovery

If any fees owed to Kirya (including cancellation penalties, subscription charges, or commission payments) remain unpaid after the due date, interest shall accrue at a rate of 2% per month on the outstanding balance. In the event that Kirya is required to take legal action to recover any unpaid fees, the user shall be liable for all reasonable legal costs, court fees, and collection costs incurred by Kirya, in addition to the outstanding balance and any accrued interest.

13. Kirya Shield (Damage Protection)

Kirya Shield provides damage protection for hosts on every booking. A non-refundable damage waiver fee is charged to the guest at checkout. Shield coverage limits depend on the host plan tier: Starter up to 500 euros, Pro up to 1,500 euros, Elite up to 3,000 euros per claim. The claim process operates as follows: (a) The host must file a claim within 72 hours of guest checkout, including photos, a description, and a repair quote with the contractor or service provider name, VAT or business registration number, work description, and price. (b) Kirya reviews the claim within 48 hours against turnover photos and inventory. Every claim is reviewed and decided by a real person on the Kirya team. (c) If approved, the host receives an approval notice (not a payout). A 30-day receipt-upload window begins on the date of approval. (d) The host must upload a valid repair receipt within 30 days. A valid receipt must include: the contractor or service provider name, VAT or business registration number, description of work performed, total amount charged, and date of service. For replacement items, a purchase receipt must include the item description, retailer name, amount, and date. (e) Kirya verifies the receipt and pays the approved amount via Stripe within 48 hours of verification. (f) If no receipt is submitted within 30 days, the claim status changes to Expired (No Receipt Submitted). The host may refile the claim once with a new repair quote, subject to the same review process. Automated email reminders are sent at day 7, day 21, and day 28 after approval. The core rule is: no invoice, no payout. Kirya reserves the right to deny or reduce claims where evidence is insufficient, damage appears pre-existing, or the claim was filed outside the 72-hour window.

14. Prohibited Conduct

You agree not to use the Service for any illegal purpose, to post false or misleading content, to harass or threaten other users, to attempt to circumvent platform security, to scrape or collect user data without permission, or to interfere with the proper functioning of the platform. For Developer Services, circumvention of the lead attribution system (including taking attributed leads off-platform to avoid commission) is a breach of the Developer Services Agreement and may result in penalty charges as set out in that agreement. Kirya reserves the right to suspend or terminate accounts that violate these Terms.

15. Intellectual Property

All content, trademarks, logos, and software on the Kirya platform are owned by Kirya or its licensors. You may not copy, modify, distribute, or reproduce any part of the platform without our written permission. Content you upload (such as property photos and descriptions) remains yours, but you grant Kirya a non-exclusive licence to display it on the platform for the purpose of providing the Service.

16. Limitation of Liability

Kirya acts as a platform connecting hosts and guests. We do not own, manage, or control the listed properties. We are not liable for the condition of properties, the actions or behaviour of users, personal injury, property damage, or disputes between hosts and guests. Our total liability to you in any circumstance shall not exceed the fees you have paid to Kirya in the 12 months preceding the claim.

17. Indemnification

You agree to indemnify and hold Kirya harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of a third party, or any content you upload to the platform.

18. Dispute Resolution

If a dispute arises between you and Kirya, we encourage you to contact us first at support@mykirya.com so we can try to resolve it informally. If we cannot resolve the dispute through direct communication, it will be governed by the laws of Malta, and the courts of Malta shall have exclusive jurisdiction.

19. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you by email or through a notice on the platform at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court, the remaining provisions will continue to apply. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

21. Governing Law

These Terms are governed by and construed in accordance with the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the Maltese courts.
